Difference Between A Rental Agreement And A Lease

While renting out your property, you will need to take into consideration the differences between a lease and a rental agreement. This will allow you to make the best decision for your needs.

When a property is rented, the tenant can decide whether to offer the tenants a lease or a rental agreement. These two terms have vast difference though they are often used interchangeably

A rental unit on lease implies that the property has been leased for a definite period. It has a finite term such as six month or a year during which period the tenant occupies the rented property. The tenant and the landlord are expected to adhere to the terms and conditions of the written agreement during this time period also known duration of the lease. A lease provides stability to your property that comes with locking in a tenant for a specified period of time.

During the lease period until the lease expires, neither tenant nor the landlord may alter any terms of the agreement except both parties agree to the change. For instance, if the current amount of the rent is $450, the landlord may not increase this amount until the lease expires.

In a lease, tenants are bound to make monthly rent payments as approved and are obliged to follow any code of conduct or other conditions in the lease while it’s in effect.  The tenant may not leave the property without breaking their lease.

Typical rental agreements are month-to-month. And there is no definite period of residence. After a  30 day period both the landlord and tenant are free to modify the terms of rental agreement which may include a rent increase or a request to vacate the property. In most states, both landlord and tenant are required to give 30 days’ notice before any changes can be made. But in states that does not require a notice, you are free to change any part of the rental agreement at your discretion.

Rental agreements are practically useful for landlords who face difficulty in finding suitable new tenants, particularly if they are in areas that cater to students or professionals on the move. As long as neither party has stated that the tenant will vacate the premises, a rental agreement is normally auto-renewed without notice after each 30-day period has elapsed.

Month-to-month agreement provides a freedom appreciated by tenants and landlords, and landlords who offer these arrangements enjoy an edge over landlords who require long-term leases.
